Songs that Unite Web Shop Terms and Conditions
This agreement is between you and the Uniting Church in Australia - Assembly (the Assembly) (ABN 16939630947). The Assembly governs your use of the Songs that Unite Web Shop (The "Songs that Unite").
Songs that Unite
The Uniting Church in Australia - Assembly is the provider of the Songs that Unite Music distribution service, which permits you to purchase digital content for end user use only under the terms and conditions, set forth in this Agreement.
Requirements for the use of Songs that Unite Service
Songs that Unite is available for individuals aged 13 years or older. If you are 13 or older but under the age of 18, you should review this Agreement with your parent or guardian to make sure that you and your parent or guardian understand it.
Use of Songs that Unite requires compatible devices, Internet access, and certain software; and may be affected by the performance of these factors. High-speed Internet access is strongly recommended for regular use and is required for video. The latest version of software is recommended to access things such as PDF's and video and may be required for certain transactions or features and to download, as the products on sale evolve. You agree that meeting these requirements, which may change from time to time, is your responsibility.
Purchases
Products distributed through Songs that Unite are sold as fit for the purpose and will be consistent with the product description provided prior to purchase. If the product is not fit for the purpose for which it was sold then the Songs that Unite refund policy will apply. Refunds will not be given where the reason is other than a failure of the product to perform as described. For example changing ones mind about the quality or usefulness of a song, or that a different membership package should have been purchased. 'My Account' usage
As a registered user and supporter of Songs that Unite, you may establish an account ('My Account'). Don't reveal your password and username to anyone else. You are solely responsible for maintaining the confidentiality and security of your account and for all activities that occur on or through your account, and you agree to immediately notify the Assembly of any security breach of your 'My Account'. The Assembly shall not be responsible for any losses arising out of the unauthorized use of your account.
Before you can use your account you will be sent a link which must be clicked on so your account is activated for the first time. Once you have activated your account, you will not need to activate it again. Thereafter in order to purchase and download products and music from Songs that Unite, you must log in by entering your Songs that Unite username and password. You will be able to purchase and download products during each visit to the site where you have logged in.
You agree to provide accurate and complete information when you register with, and as you use, Songs that Unite, and you agree to update your Songs that Unite Registration information and keep it accurate and complete. You agree that the Assembly may store and use the 'My Account' information given by you for maintaining and billing fees to your account, as well as for communicating about Songs that Unite news and events and other related initiatives.
Violation of These Terms of Use
The Uniting Church in Australia Assembly (the Assembly) may disclose any information we have about you (including your identity) if we determine that such disclosure is necessary in connection with any investigation or complaint regarding your use of the Site. The Assembly reserves the right at all times to disclose any information that the Assembly deems necessary to comply with any applicable law, regulation, legal process or governmental request. The Assembly also may disclose your information when it determines that applicable law requires or permits such disclosure, including exchanging information with other companies and organizations for fraud protection purposes.
You acknowledge and agree that the Assembly may preserve any transmission or communication by you with it through the Site or any service offered on or through the Site, and may also disclose such data if required to do so by law or it determines that such preservation or disclosure is reasonably necessary to (1) comply with legal process, (2) enforce these Terms of Use, (3) respond to claims that any such data violates the rights of others, or (4) protect the rights, property or personal safety of The Assembly, its employees, users of or visitors to the Site, and the public.
You agree that the Assembly may, in its sole discretion and without prior notice, terminate your access to the Site and / or block your future access to the Site if it determines that you have violated these Terms of Use or other agreements or guidelines which may be associated with your use of the Site. You agree that the Assembly may undertake any legal actions that are appropriate in the seeking of a remedy to any breaches of the terms of Use and that this may include the seeking of financial compensation for harm done through such a breach.
You agree that the may, in its sole discretion and without prior notice, terminate your access to the Site.
Disclaimer
The Assembly does not promise that the site or any content, service or feature of the site will be error free or uninterrupted, or that your use of the site will provide specific results. The site and its content are delivered on an "as available" basis.
All information on the site is subject to change without notice. The Assembly cannot ensure that any files or data downloaded will be free from viruses. Your sole remedy against the Assembly for dissatisfaction with the site or any content is to stop using the site.
The Assembly reserves the right to do any of the following, at any time, without notice: (1) to modify, suspend or terminate operation of or access to the Site, or any portion of the Site, for any reason; (2) to modify or change the Site and any applicable policies or terms; and (3) to interrupt the operation of the Site to perform routine or non-routine maintenance, error correction, or other changes.
Feedback and Information
Feedback is always welcome and will be used to enhance the quality of the service provided. Any feedback you provide at this site shall be deemed to be non-confidential and as such can be shared with others at the discretion of the Assembly.
